Sales Terms and Conditions

 

Disclaimer: Failure to read these terms and conditions will under no circumstances render them altered or void, and it is the duty of the customer to read the agreement carefully. Only laws of Mauritius will apply to all sales. We reserve the right to amend, modify and/or alter the content of this document at any time, without prior notice.

We reserve the right to ask for ID verification and Business Registration Certificates before shipping any order. We reserve the right to cancel an order without having to give an explanation, please see condition 8 below for further information regarding cancelled orders.

 

Terms and conditions:

 

1. Sale

  • We sell ‘Net Ex Work’ (Delivery from the Farm in Mauritius).

  • Export documents include: CITES permit, standard international veterinary certificate, invoice.

  • CITES export permits take approximately 30 days.

  • If you have special paperwork requirements in your country – please take care to ensure sufficient time is allocated to obtain them. Delays in presenting documentation can result in additional charge (see further terms and conditions)

  • All permits must be obtained before shipment i.e. import permits and cites permits

  • A copy has to be duly submitted to the breeder and buyer.

  • We cannot guarantee the sex of any animal unless otherwise specified. Special health certificate or lab tests are not included.

  • All orders comprise of 90% A grade animal and minimum of 10% B grade animal.

  • All quotes are valid for 7 days.

  • All tortoises are measured before delivery to buyer; Prices will be revised according to final measurement and may vary from quote.

  • Note: We will hold your confirmed order in our facilities for not more than 60 days upon receipt of deposit, after which they are placed for sale again if full payment is not received in time.

  • Generally, the buyer hires a freight agent for the transport of the order to the final destination.

  • Special cases: Freight cost and other local costs can be provided only to facilitate the transport of tortoises to the buyer.

  • The buyer accepts that any problems that can arise with freight transportation and conditions provided by Airlines are not the responsibility of the seller.

 

2. Method of Payment:

  • We only accept Cash Before Delivery by Telegraphic Transfer.

  • A 30% Net deposit is required to confirm an order and start Cites procedures.

  • The deposit is nonrefundable in case of cancellation of order by the buyer.

  • The 70% remaining net balance is due before shipment departs.

  • All bank charges are for the account of the buyer.

 

3. Other local charges:

  • All permits, levy, documentation fees, local transport, veterinary costs etc… are for the buyers account.

  • Freight, packing, insurance and all other charges are charged to the buyers account.

  • Should there be increases in charges, the final cost will be adjusted and the buyer will be kept informed.

 

5. DOA

  • In case of mortality of an animal on arrival or during transportation, the buyer is responsible to inform us of the mortality within 48hrs of delivery.

  • The buyer also needs to provide pictures and a video of the reading of the microchip number from the animal.

  • An original certificate with microchip number confirming the mortality with an official stamp from the Ministry of Agriculture veterinary section of the importing country has to be forwarded to the exporter with 48 hrs of arrival.

  • A declaration form of the airline providing transport also must be provided.

  • If these documents are not provided no refund applies.

 

6. Shipping

  • Orders are shipped as soon as full payment is credited to the bank account of the breeder, provided that all permits and clearances are in order.

  • The seller cannot hold the tortoises for long on the farm once they have been made ready for shipment.

  • A maximum of 14 days is given free of charge to hold tortoises prior to their delivery to airport.

  • Once the order has left our premises, the buyer becomes fully responsible for the order.

  • The seller shall not provide any warranty or accept any liability after delivery of the animal.

 

7. Delays

  • If any delay by the buyer arise, a keeping fee will be charged starting on the 15th day.

  • The buyer must take insurance to cover all eventualities during the keeping period on the farm.

  • The seller will not be responsible for any event that may arise during this period.

  • The keeping fee will have to be paid in full before shipment of animals by Telegraphic transfer.

  • Keeping fee:

                                  Hatchlings: 2 euro per day/animal

                                  Juveniles: 4 euro per day/animal

                                  Subadults: 8 euro per day/animal

                                  Adults: 10 euro per day/animal

 

  • Veterinary visit charge (35 Euro per animal / 3 months) applies in case a visit is needed. The Vets transportation fee may come at an extra cost.

 

8. Cancellation of order

  • In the event of a cancellation of an order or inability to perform the delivery of the animal by the seller, the seller shall refund the buyer the amount paid in full.

  • In case of cancellation of order by a buyer after full payment, permits, clearance obtained etc, no refund will apply.

 

9. Advance Payments

  • Advance Payments on orders are subject to the approval of the exporter. Upon confirmation of an order, the exporter requires 30% of the Order Value (Net of all Bank Charges) which is nonrefundable in the case of cancellation by the buyer. The remaining balance of 70% of payment must be made (Net of all Bank Charges) before shipment of the animal. Maintenance fees also must be cleared before shipment. Delivery will be performed after all invoices have been settled in full. No refunds apply once the balance has been paid in full.
